Architectural Change Requirements

  1. No work or commitment of work will be made by me until I have received written approval from the Association.
  2. All work will be done at my expense and all future upkeep will remain at my expense.
  3. All work will be done expeditiously once commenced and will be done in a good workman-like manner by myself and/or a licensed and insured contractor.
  4. All work will be performed at a time and in a manner to minimize interference and inconvenience to other home owners.
  5. All work will be completed within thirty (30) days of the estimated completion date. Homeowner must notify KMC of any delays in completion after thirty (30) days and provide an updated completion deadline of the stated project. Maximum duration for completion is limited to ninety days (90). After ninety days (90), this ACR form will be null and void and homeowner must re-submit an additional ACR form to the Wakefield Committee/Board for approval.
  6. I assume all liability and will be responsible for all damage and/or injury which may result from performance of this work.
  7. I will be responsible for the conduct of all persons, agents, contractors, and employees who are connected with this work.
  8. I will be responsible for complying with, and will comply with, all applicable federal, state and local laws, codes, regulations and requirements in connection with this work, and I will obtain any necessary governmental permits and approvals for the work.  I understand and agree that the Association, the Board of Directors, the agent and/or the Committee have no responsibility with respect to such compliance and that the Board of Directors and/or its designated Committee approval of this request shall not be understood as the making of any representation or warranty that the plans, specifications or work comply with any law, code, regulation or governmental requirement.
  9. I understand that a decision by the Committee is not final and that the Board of Directors may reverse or modify a decision by the Committee upon the written application of any owner made to the Board of Directors within ten (10) days after the Committee makes its decision.
  10. All work must comply with the latest publishing of the Wakefield Declaration Covenants and Restrictions.
  11. The Wakefield ACC committee has the right and obligation to inspect the finished alteration to ensure the project has been completed as requested in the ACC.
  12. Page 15 section 4.3 of the Wakefield covenants states, the committee shall approve or disapprove any matters submitted for approval with in fifteen (15) days after all required information is submitted to it. IF not approved withing (15) days, it is assumed that the request has NOT been approved.

NOTE:  All submitted materials shall remain the property of the Association.  It is highly recommended that you make a copy for your personal records.
